Username Forest Industry Law Alert: U.S. District Court Rules That Wood Waste Is Not a Hazardous Substance Under CERCLA, but May Still Result in Liability in Aquatic Environments 7/17/2007 In a closely watched decision, a federal district court judge ruled recently that chemicals created by the decomposition of raw wood waste in the aquatic environment can create Superfund liability for the owner of the site where the wood waste is located. In a June 22, 2007 slip opinion, Judge Ronald Leighton of the United States District Court for the Western District of Washington in Arkema, Inc. v. Asarco, Inc. (No. C05-5087 RBL) allocated liability under the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) for the cleanup of portions of the Hylebos Waterway in Tacoma, Washington to Weyerhaeuser Company, owner of the portion of the waterway where the wood waste was located. In apportioning liability the court concluded that wood waste was not, in and of itself, a hazardous substance. However, under certain aquatic conditions, the court ruled that decomposition of wood waste could result in a release of hazardous substances and provide a basis for liability under CERCLA. In the underlying action Arkema sought to recover response costs for dredging contaminated sediments and wood waste from portions of the Hylebos Waterway. Arkema’s dredging activities included property owned by Weyerhaeuser containing a substantial amount of raw wood waste. In seeking to recover the costs of the wood waste removal, Arkema argued that raw wood waste is a hazardous substance giving rise to CERCLA liability because its decomposition produces hazardous substances. In its holding, the court concluded that wood waste was not a hazardous substance, because wood does not contain any hazardous substances; however, the court found that under &quot;very specific conditions,&quot; where wood is &quot;placed in significant volumes in still water,&quot; the degradation of wood attracts microorganisms that excrete listed hazardous substances such as ammonia, hydrogen sulfide, and 4-methylphenol. The court found that, in the Hylebos Waterway, anaerobic conditions, coupled with the large volume of wood debris, produced this kind of microorganism release of hazardous substances. Because Weyerhaeuser owned the property containing the decomposing wood debris, both at the time the microorganisms released the hazardous substances and at the time Arkema incurred dredging response costs, the court held Weyerhaeuser liable under CERCLA as an owner/operator of a contaminated site. Although Arkema sought cost recovery from Weyerhaeuser under both CERCLA and Washington’s Model Toxics Control Act (MTCA), the court ruled only on the CERCLA liability claim and did not reach the issue of whether wood waste itself is a hazardous substance under MTCA, because Weyerhaeuser had MTCA contribution protection by virtue of a consent decree previously entered with the Washington Department of Ecology. The court also declined to rule on additional arguments presented by Arkema that Weyerhaeuser’s disposal of the wood waste created the &quot;threat of a release&quot; sufficient to satisfy CERCLA liability, and that the disposal of the wood waste created liability for Weyerhaeuser as a &quot;generator&quot; of hazardous substances. In light of the Arkema decision, parties that own or operate aquatic lands with significant deposits of wood waste may reduce their potential for liability if testing shows that the kind of hazardous substances cited by the court are not detectable or present only at levels that constitute natural background. An environmental consultant with experience dealing with wood waste sites should be used to ensure that the timing of the testing is designed to reflect year-round conditions, rather than seasonal variations when chemicals such as sulfide can temporarily spike. Yes, very fundemental policy decisions about the future for the city are going to be made in the coming few years including the basic urban design of the city and how and where is the city is going to grow. With all of the development interest coming into town, the right decisions need to be made or the city will be built out in a poor way. Trying to reverse course and trying to make an attractive place after they have been built out badly is very difficult as University Place is finding out. Here's some questions pertaining to downtown: 1) What actions have you taken in the last 5 years to support downtown and the neighbood business districts? 2) Downtown Tacoma is pocked with empty lots and empty buildings and likely has a high street level retail vacancy rate. <description> <![CDATA[捣鼓了下模版。     样式没变，就是换了个图，配了个色。在这个懒洋洋的夏日午后，看上去～～精神了一些。至少我这么觉得。可能是太久没动模版了，很多代码都忘了。为一条线的颜色不对，反复找得抓狂。本来想走粉嫩草莓的路线，换了几个粉色的背景和字色都觉得不妥，干脆上了我最喜欢的颜色。对呀，我就是喜欢果绿呀。有的博其实我挺有兴趣的，但不太敢开。比如BSP是MSN的，相册什么的放一大堆在页面上，一开浏览器就傻眼。还有CN的和Sina的，巨慢。而且抓虾抓CN的RSS好像抓不全，Sina的如果不是显示全文，用抓虾也抓不住。中通速递不好用，同城快递很好用。我现在也学会了一票否绝。很多时候，权衡是没有用的。另外，因为在&#8220;纯文本&#8221;里上了图，我决定将分类名改成&#8220;纯文本不纯&#8221;。特记。由姚明同学的婚宴，BT们今天讨论了一个关于婚酒的问题，果然狠BT！这是辞职后第一个不用开会的礼拜一，纪念下。]]></description>

<title> <![CDATA[Widget年？]]></title>

在平台类公司工作的时候，一度对mashup很着迷。认为应用的开发，迟早是一堆模块拼凑的事。所以，早期的Gadgets、Widget、WebService、RSS
Feed，都看了一些。对Netvibes为首的，象my.potu、iGoogle、msn
spaces，觉得他们才是方向，会取代portal的。Yahoo的pipes出来的时候，也玩了几天，终因太难，放弃了。
 

Widget要解决的就是非技术人员的拼凑欲。就象是非专业人士的卡拉OK欲、个人播客欲。不要拼家伙、器材，只要拼满足感和露脸感。
 

但好多IT方案，都是把非专业人士往专业人士那个圈里培养。这是不好的。虽然我理解，而且也相信，这个模式会有很大的商业成功。因为眼前就有很多成功的例子。比如，驴子。本来是一件很简单的事，背上包、独自上路。想哲学问题也好，看野花风景也好，期浪漫邂逅也好。只是背包、上路而已。现在却已经完全不是那么回事了。什么样的包、什么样的鞋、什么样的头灯……自己DIY一身行头，根本不敢往那个圈里靠。奢侈的驴子。成就了多少成功的户外用品企业和商店。
 
在学习Widget的时候，分过几个类别：
1、RSS类。只要一个RSS Feed
URL，就可以把对方的内容，集成到自己的页面上来；

2、API类。同一个网站内，通过WebAPI集成；不同的网站，通过WebService集成；

3、Form类。同一个网站或应用，通过html程序片断，共享自己的数据。
 
现在看来，RSS类的应用，基本没什么变化。还是一个Feed
URL。但内容更丰富了。不仅新闻、Blog可以Feed出去，图片、产品，也可以通过RSS方式，方便地共享了。
 

API类，似乎更加弱化。Amazon等电子商务网站，开始开放自己的API，似乎仅限于jsp的。WebService方面的功能，估计只有深度合作的才可以做得到。
 
但这一类的集成，越来越多地倾向于使用script或可嵌入的Flash
Object。比如豆瓣、Yupoo、Google
Reader等，都提供。在自己的网站上，加入一个空白的html区域，把script加进来，内容就展现出来了。
 

Form类的，其实是一个网站规划和开发者自己应该注意的事，哪些功能可以复用，就把它做成独立的模块，可以到处去引用。这一功能，在很多CMS中，体现得尤为明显。用户可以把“最新的文章”、“相关的产品”等，定义成独立的TAG，添加到不同的页面上去。统一了数据和展现管理的源头，非常方便、实用。
 

这样来看，Form类，其实应该定义为“预定义的功能模块”更为合适一些。
 

不过，RSS、Script类的Widget，现在也发现一些“先天的”缺陷。
1、资源少。

支持RSS输出的资源不少。到各个网站上去找，可以找得到；到RSS托管商的网站上去找，更多。但大多的问题在于，只提供feed
URL，不提供嵌入式的代码。还是要向Google Reader学习，它的shared
items可以共享为页面、feed url、script代码。总有一样适合你。
 
2、某些网站代码限制问题。

在BSP网站上，尤其明显。比如新浪的博客，源代码编辑后，会自动把script代码屏蔽掉；可以嵌入flash对象，但某些参数也不支付。
 
3、SEO问题。

RSS和Script方式，一句话描述，就是“展现在这里、数据在别处”。搜索引擎抓不到数据。如果想通过这种方式，做一个内容，或产品的集市，让更多的人搜索得到，估计是办不到的。
 

这解决这个问题，只有一条路走。把RSS和Script当成自己的“后台数据来源”，编辑加工之后，再通过自己的网站展现出去。

 

Widget是个方向。但如何实现简易的、任何人都可以DIY的应用，而不是必须了解更多的技术细节，才可以用得起来，还有很长的路要走。也许明年，会是个Widget年。
